Luxe Family - Travel | Agency Terms and Conditions
These are the agency terms and conditions ("Agency Terms and Conditions") on which we, Luxe Family Ltd. ("Luxe Family", “we”, "us"), will process a booking for your stay requirements. This agreement describes the legal framework in which you participate on Luxe Family Ltd’s website www.luxefamilytravel.com (“the Website”), what your rights and responsibilities are and what you can expect from us.
You are advised to read these document carefully prior to booking.
All use of the Website and use of booking services is on the Agency Terms and Conditions below. If you do not agree to these conditions cease use of the Website immediately. You may print and keep a copy of these Agency Terms and Conditions. We reserve the right to change them at our discretion by changing them on the Website.
When processing your booking we will arrange for you to enter into a contract with the provider of the travel related service including, among others, tour operators, hotels, accommodation providers and cruise companies ("Travel Provider"). We are acting as the disclosed Travel Provider’s agent in arranging your booking and the Travel Provider is the principal, or the agent to the principal.
Luxe Family do not actually operate any of the accommodation or tour services ourselves. We are not a tour operator. We do not arrange or create combinations of travel products; we simply facilitate your connection to the Travel Provider.
As the contract for the accommodation or other Luxe Family travel experience featured on the Website is between you and the Travel Provider, there are additional terms and conditions governing the contract as each Travel Provider has its own terms and conditions. Whilst we may provide details of the Travel Provider's cancellation policies, these details are not intended to be a full list of the terms and conditions of any supplier. We, therefore, are not responsible or liable in any way whatsoever in relation to any dispute arising between you and the Travel Provider regarding their charges, quality of services, facilities or otherwise. You should make all your claims or complaints against, or settle it directly with, the Travel Provider concerned.
In completing your booking with us you are accepting our Agency Terms and Conditions, regardless of whether the booking was made over the phone or the Website. You may decide to book just a room or a featured Travel Provider’s offer (“Luxe Family Offer”). In the case of the Luxe Family Offers, please note that irrespective of the various services included in the Luxe Family Offer, they do not constitute a package as defined in the Package Travel, Package Holidays and Package Travel Regulations 1992 ("Package Travel Regulations 1992") nor the Civil Aviation (Air Travel Organisers’ Licensing) Regulations 1995, Amended 2003 ("ATOL Regulations"). The services are all provided by one single Travel Provider and not put together as a package by Luxe Family.
Before proceeding with a booking, in the case of the Pregnancy Holidays (Babymoons), the expectant mother must have sought the advice of their General Practitioner and if necessary has appropriate permission from them. Babies must be up to date with their vaccination schedule and the trips should have been discussed with their doctor for their approval and advice.
- For Luxe Family Offer bookings paid by credit card, Luxe Family will pre authorise your credit card through the PayPal payment system, on behalf of the Travel Provider, to guarantee the reservation. No charge will be made to your credit card until your reservation has been confirmed by the Travel Provider.
- Once the Travel Provider has confirmed your reservation, your credit card will be charged for the full amount of the booking unless otherwise previously indicated. Upon making a reservation payment to Luxe Family, your card will be charged at your bank's rate of exchange for the Travel Provider’s currency.
- Other payment methods are by cheque payable to Luxe Family Ltd. or by bank transfer.
- Where you only pay a deposit you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the Travel Provider who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.
- Once these payments have been made, they are only refundable if the booking is cancelled within the Travel Provider’s cancellation period. Hotel cancellation policies may outline a period before check-in when cancellations will be subject to payment of a penalty. This period does not include the day of arrival – so, for example, a cancellation policy of ‘24 hours’ means a reservation must be cancelled at least 24 hours before midnight on the day before arrival to avoid the penalty.
- Any cancellations must be made by emailing Luxe Family as soon as possible.
- The currency in which prices are displayed is the Travel Provider’s one but you can always select another currency in which to see the prices of the participating Travel Providers. However, these converted prices are based on various publicly available sources using daily spot rates and should be used as guidelines only. Rates used by Luxe Family are believed to be accurate, but our respective suppliers do not warrant or guarantee such accuracy and actual rates may vary. The prevailing and real rates on our website are the ones in the Travel Provider’s currency, in which your credit card is charged, as displayed during the booking process.
It is important that you understand that payment at the time you are making your Luxe Family Offer booking does not in itself mean that your booking is confirmed. Your booking is only confirmed when we send you our email confirmation of booking, so it is your duty to provide us with an accurate email address. If in the time between your payment and us seeking to confirm your booking with the Travel Provider the travel product has become unavailable your credit card will not be charged.
Our confirmation email will serve as proof of valid reservation and will contain relevant information about the reservation and particulars of the service concerned. Please read and check carefully all the information contained in our confirmation email to ensure that it conforms to your reservation. Advise us of any errors within two days of receipt of your confirmation by contacting us. Please note that we will not accept any responsibility for incorrect information if we are not informed within this timeframe. Please ensure that the names given are the same as in the relevant passport.
It is your responsibility to contact Luxe Family if you do not receive a confirmation email. If you think you haven't received one, please check your junk mail folder to make absolutely sure.
Luxe Family cannot be held liable for errors or omissions in bookings either made by the Travel Provider or as a result of any kind of system failure.
Cancellations and amendments
Luxe Family do not charge for cancellations or amendments to your bookings. However, each booking is subject to the Travel Provider's booking and other terms. Please be aware that the Travel Provider may impose a cancellation charge depending on how far in advance of the booking you cancel, which may be 100% of the cost of the booking. We do not accept liability for any cancellation charges incurred.
You are, therefore, strongly advised to read such terms and conditions, which are displayed on our Website, carefully before making your reservation. You will be bound by such terms and conditions once your reservation is confirmed. In case of cancellation, we suggest that you should promptly and directly contact us to minimize any penalty or charges payable.
Many Travel Providers require you to take out travel insurance as a condition of booking with them as detailed in their Booking Conditions. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses.
Sometimes your Travel Provider may need to make a change. If you have already booked we will let you know as soon as we can, if there is time before your departure. In the unlikely event that your Travel Provider has to make a major change or alteration to your booking, they will offer you the option of accepting the change or cancelling the booking and receiving a full refund of all monies paid to us in connection with the booking.
We do not accept responsibility for any expenses or costs incurred by you as a result of the change and we do not accept responsibility for changes or cancellations that are due to unusual or unforeseeable circumstances beyond our control. These can include war or threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental action or accommodation ceasing to be available.
Where inaccuracies relate to the understatement of the price of a specific product you will be offered either a full refund of money paid on that booking only or the opportunity to maintain that booking on receipt of the additional payment which is necessary or an additional option being an alternative booking of equivalent or superior standard.
Passport and Visa requirements
We endeavour to provide general information about the visa requirements for your destination. Your specific passport and visa requirements, and other immigration requirements, are your responsibility and you should confirm these with the relevant embassies and/or consulates. Neither Luxe Family, nor the Travel Provider, accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Most countries now require passports to be valid for at least 6 months after your return. It is also your own responsibility to comply with all local health and custom requirements applicable to the place you are going to visit.
Due to your specific circumstances, you must check with your own doctor about any health formalities required for your trip. You should also seek yours and/or your baby’s doctor’s approval before booking your trip. Please, bring this approval in writing if you are pregnant and hand a copy to the spa staff before starting treatment, when requested.
If you have any dissatisfaction regarding your travel arrangements they should be reported to the relevant Travel Provider or their local supplier or agent immediately.
If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint. The amount of compensation you may be entitled to may be reduced or you may not receive any at all depending upon the circumstances.
If you wish to also make a formal complaint upon your return home then these should addressed in writing to Luxe Family Ltd.
Limitation of liability
For the avoidance of doubt, your booking is directly with the Travel Provider. To the extent that we are not negligent in the provision of our services to you, Luxe Family accepts no liability or responsibility for any complaint, loss, damage, expense or other claim in respect of any aspect of your bookings or travel arrangements.
Specifically, we will not be liable for any act or omission by any person not employed directly by us and whilst we have chosen our Travel Providers with care we have no control over our Travel Providers and so cannot be held responsible for any action or omission of our Travel Providers or their servants, agents or employees.
Moreover, we cannot be held responsible for any loss, damage or expense incurred or suffered by you which results from strike, civil commotion, fire, flood, war, threat of war, terrorist activity, national or nuclear disaster, late delivery, adverse weather conditions any act of God and / or any other event which is outside of our reasonable control.
In no circumstances shall we be liable for any economic loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of reputation, loss of anticipated savings arising out of the failure or delay in perfoming the services under these terms of business or otherwise in connection with these terms and conditions; or for any indirect, special or consequential loss or damage (howsoever arising).
Your Booking Data
The booking information that you provide to us will be passed on only to the relevant Travel Providers of your travel arrangements or other persons necessary for the provision of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary and religious requirements.
If you travel outside the European Economic Area ("EEA"), controls on data protection may not be as strong as the legal requirements in the United Kingdom.
If we were not authorised to pass this information to the relevant Travel Providers, whether in the EEA or not, we would be unable to arrange your booking. In making a booking, you consent to this information being passed on to the relevant parties.
English law shall apply to these Agency Terms of Business notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms. Any formal legal notices should be sent to us by confirmed post.
Although we will endeavour to pass any reasonable request on to your Travel Provider, we are unable to guarantee that the request will be met.
While Luxe Family does its outmost to ensure all information on its website is accurate, travel information may change at any time. Facilities and amenities in accommodation may be temporarily unavailable for operational reasons. Where this happens we will do our best to advise you as soon as possible. We cannot accept liability for errors or omissions in the description.
Any opinions expressed on this Site are subjective. We do not necessarily endorse nor are we responsible for the accuracy or reliability of any opinion, advice or statement made on the Site. In no event shall we be liable to you for any indirect or consequential loss, loss of profit, revenue or goodwill arising from your use of the Site or information on the Site.
In the case of some Travel Providers, a disclaimer may be required to be signed before the booking takes place, for example, before a spa treatment. Failure to sign the disclaimer to the satisfaction of the Travel Provider may result in the service being cancelled. We will have no liability to You whatsoever in this circumstance.
If you make a booking with Luxe Family it is understood you have read, understood and accepted these terms and conditions. Any person who arranges a booking with Us on behalf of other persons does so on the basis that they undertake to communicate these Agency Terms and Conditions to all such other persons. No variation of these Agency Terms and Conditions shall be valid unless agreed in writing by us.
